The certificate of marital capacity is the civil status document that confirms the right of the citizen of the Republic of Moldova to enter into marriage in accordance with the normative framework of the Republic of Moldova (expressing proof of the absence of impediments to marriage). The document is issued based on the data from the civil status documents and is intended for use in the states that form the territorial scope of the CIEC Convention no. 20 regarding the issuance of the certificate of matrimonial capacity signed in Munich on September 5, 1980: Germany, Belgium, Spain, Greece, Italy, Luxembourg, Netherlands, Portugal, Switzerland, Turkey, Republic of Moldova.
Marriage between two Moldovan citizens:
To request the act indicated in this column, the citizen of the Republic of Moldova will present:
- identity card with accompanying card or valid Moldovan passport in original and photocopy of the Moldovan citizen;
- Moldovan divorce certificate issued in the name of the applicant or Moldovan death certificate of the spouse, as the case may be;
- copy of the future spouse’s passport (only the page with the photo) or simple copy of the Moldovan identity card;
Marriage with a foreign citizen, will be presented:
- copy of the future husband’s passport (photo page only);
- certificate of free status / marital status of the future spouse with superlegalization on the original (applies to Global Affairs Canada) translated into Romanian and with the superlegalization applied to the translation. In the case of a person with another nationality.
In order to request the act, the presence of the citizen of the Republic of Moldova at the embassy is necessary.
- The person’s request is sent to the Public Services Agency, which completes the document and sends it to the consulate.
- When submitting the application, the payment of fees can be made in the form of a bank draft or e-transfer.
- In certain cases, in order to clarify some facts, the consular officer is entitled to request other supporting documents/certificates.
- The Consulate/Embassy sends the document to the home address of the person indicated in the application, by courier (DHL/self-addressed and prepaid envelope). If he did not request home delivery, the Consulate/Embassy informs the applicant about the schedule of picking up the act from the consulate with picking up the act by the applicant or the duly authorized person.
